Geeks Global respects the intellectual property rights of others and expects all users, visitors, and third parties interacting with our website (geeks-global.com) to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), 17 U.S.C. § 512, we have established the following policy for addressing claims of copyright infringement.

1. Notification of Claimed Infringement

If you believe that any content appearing on our website infringes your copyright or the copyright of a party on whose behalf you are authorized to act, you may submit a written DMCA notice to our designated Copyright Agent. Your notice must include all of the following elements as required by 17 U.S.C. § 512(c)(3):

4. Your contact information, including your name, mailing address, telephone number, and email address.
5. A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
6. A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or are authorized to act on behalf of the owner.

We recommend submitting notices via email for the fastest response. Please write “DMCA Takedown Notice” in the subject line.

2. Counter-Notification Procedure

If you believe that material you posted was removed or disabled as a result of a mistake or misidentification, you may submit a written counter-notification to our Copyright Agent. Your counter-notification must contain the following information as required by 17 U.S.C. § 512(g)(3):

1. Your physical or electronic signature.
2. Identification of the material that has been removed or disabled and the location at which the material appeared before it was removed or disabled.
3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if outside the United States, to the jurisdiction of the United States District Court for the Northern District of California), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Upon receipt of a valid counter-notification, we will promptly provide a copy to the original complaining party. We will restore the removed material within 10–14 business days after receipt of the counter-notification, unless our designated agent receives notice that the copyright owner has filed an action seeking a court order to restrain the allegedly infringing activity.

3. Repeat Infringer Policy

In accordance with the DMCA and other applicable law, Geeks Global has adopted a policy of terminating, in appropriate circumstances, the accounts of users who are deemed repeat infringers. We may also, at our sole discretion, limit access to our website and/or terminate the accounts of any users who infringe the intellectual property rights of others, whether or not there is any repeat infringement.

4. Disclaimer & Limitations

Submitting a DMCA notice with materially false or misleading information may expose you to civil liability and attorney’s fees under 17 U.S.C. § 512(f).
